The family received its second notice of violations July 27. The family contends that toys are not junk and that the property doesn't have a garage.
A family in Stuart has been notified its property is in violation of the municipal code in part for having an "excessive amount of toys" in the yard.
While the notice also cited other violations — which the family says it has since addressed— the declaration of toys in the yard as a public nuisance has not sat well with the family.
"We come outside a lot," said Meaghan Pike, the mother. "They’re always riding their bikes, jumping on the trampoline, shooting hoops. We are an outdoor family."
Five children live at the home, and in all, the property has nine bikes. On Thursday, the bikes were lined up between two trees.
"We don’t have a garage, so their home is actually between the two trees," Pike said. "I have told the kids, put your bikes back, put the balls back, put everything back, get it out of the yard, put it over there."
The city of Stuart said it uses a third party to conduct code inspections, and it declined to comment on the specific case.
The most recent notice provided to the family states that a re-inspection of the property is due Aug. 2.
"If you fail to abate the nuisance on the property, the City will take necessary action to clean the property and you will receive a billing invoice that list [sic] the cost of such abatement plus administrative costs associated with this enforcement action," the notice reads.
